Elaine Colavito's "Bench Briefs" Appears in Suffolk Lawyer.

Elaine Colavito had her "Bench Briefs" column published in the November 2013 issue of The Suffolk Lawyer. "Bench Briefs" is a roundup of recent court cases decided in Suffolk County trial courts. The decisions are submitted to Ms. Colavito and then included in her column.

A graduate of Touro Law School, Ms. Colavito concentrates her practice in matrimonial and family law, civil litigation and immigration matters.

Adam H. Koblenz Receives LIBN's "Leadership in Law" Award.

Adam H. Koblenz received Long Island Business News’ “Leadership in Law” Award in the category of Associate. The ceremony took place on November 14 at Crest Hollow Country Club in Woodbury.

Mr. Koblenz concentrates his practice in the areas of litigation and appeals. In addition to the firm’s duties, he currently serves as a Village Prosecutor for the Village of East Hills. He is a member of the New York State Bar Association and is admitted to practice law in the States of New York and New Jersey, and before the United States District Courts for the Eastern and Southern Districts of New York. He is a graduate of Brandeis University and The George Washington University Law School.

Mr. Koblenz was also selected to the 2013 New York Metro Super Lawyers’ “Rising Stars”list. He was recognized in the practice area of General Litigation. Rising Stars is an exclusive list, recognizing no more than 2.5 percent of the lawyers in the state.

He is currently Vice President of the Men’s Division and Tennis Co-Chair of the Children’s Medical Fund of New York’s (CMF) 38th Annual Golf & Tennis Classic at the Glen Oaks Club. He recently helped organize the “Cycle for CMF” event at Lifetime Fitness in Syosset. The Town of Oyster Bay recently honored him for his dedicated service to CMF.

The Leadership in Law Award recognizes those attorneys who carry the following qualities in their profession: dedication, hard work, skill, tenacity and excellence. The award is dedicated to those individuals whose leadership — both in the legal profession and in the community — has had a positive impact on Long Island.


Chris Coschignano Raises Funds for Wounded Warrior Project.

Firm partner and member of Oyster Bay's Town Board Chris Coschignano participated in the Oyster Bay Town Supervisor's 5K Run, which was sponsored by Sahn Ward Braff Koblenz Coschignano & Baker on October 19.

The event, which was sponsered by Sahn Ward Braff Koblenz Coschignano & Baker, coincided with the town's two-day Oyster Festival.

Councilman Coschignano ran in the 5K to raise funds for the Wounded Warrior project, the non-profit veterans service organization that offers a variety of programs, services and events for wounded veterans of the military actions.

"It was a great day at the Supervisor's 5k Run," said Coschignano. "We had over 30 runners and walkers who helped us raise over $2,000 for the Wounded Warriors Project." Friends and family were able to show their support by donating money or participating as a running or walking member of Coschignano's team.

A very grateful Coschignano was proud to say that he was able to run the entire race without walking, however, he was more proud of the camaraderie that was shown. "We all had such a wonderful time together. Thank you to all who participated and to all who donated."


Long Island Business News Honors Miriam Villani

Miriam Villani, a partner at Sahn Ward Braff Koblenz Coschignano & Baker, PLLC, was honored as one of Long Island’s Most Influential 50 Women by Long Island Business News. A special ceremony took place on October 17 at the Crest Hollow Country Club in Woodbury.

Launched in 2000, LIBN’s Top 50 program recognizes the Island’s top women professionals in business, education, government and the not-for-profit fields for their business acumen, mentoring and community involvement.

Ms. Villani was recognized for her aggressive legal representation of her clients in all environmental matters. She has guided many clients through business and property transactions using a variety of tools that helped them avoid potential environmental liability and has successfully represented clients before the environmental regulatory agencies so that they have paid significantly reduced penalties or avoided paying penalties altogether. In addition, she has litigated many environmental cases on behalf of her clients with good results.


Daniel J. Baker and John Farrell Join Touro Law's Land Use & Sustainable Development Law Advisory Board.

Daniel Baker and John Farrell have been named Members of Touro Law School's newly launched Land Use & Sustainable Development Advisory Board.

Mr. Baker concentrates his practice in the areas of real estate transactions, zoning and land use planning, corporate law and transactions, tax certiorari and condemnation/property valuation, civil litigation and criminal defense. Mr. Farrell concentrates his practice in zoning and land use planning, litigation and appeals and municipal law and legislative practice. Both are graduates of Touro College, Jacob D. Fuchsberg Law Center.

Chris Coschignano, Michele A. Pincus and John Farrell of Sahn Ward Braff Koblenz Coschignano & Baker, PLLC, recently attended the monthly breakfast meeting of the Women Economic Developers of Long Island (WEDLI) at The Woodlands at Woodbury. The guest speaker was Anthony Manetta, chief executive officer and executive director of the Suffolk County Industrial Development Agency, who spoke on the topic "Successfully Driving New Economic Development Projects for the Region." Ms. Pincus is a Board Member of WEDLI and Mr. Coschignano also serves as Councilman for the Town of Oyster Bay.


Joseph Bjarnson and Pro-Bono Co-Counsel Win Issue of Discovery against Marine Services Company.

Law360.com recently reported that a federal magistrate judge presiding over Equal Employment Opportunity Commission v. Signal International LLC, No. 12-cv-00557 (E.D. La.),ruled in favor of the plaintiffs on a discovery motion brought by the defendants who were seeking the discovery of information concerning the immigration status of upwards of 500 Indian nationals involved in the suit. Among those representing the intervening plaintiffs pro bono is Sahn Ward Braff Koblenz Coschignano & Baker, PLLC Associate Joseph Bjarnson.

U.S. Magistrate Judge Daniel E. Knowles III denied Signal International entitlement to discovery concerning the plaintiffs’ immigration status and history because such use of the information by the company may have an intimidating effect on the plaintiffs, and Signal International’s employees, involved in the lawsuit with respect to the assertion of workplace rights.

In April 2011, Mr. Bjarnson joined the Southern Poverty Law Center, the American Civil Liberties Union, the Asian American Legal Defense and Education Fund and Crowell & Moring LLP in representing the intervening plaintiffs in connection with the Equal Employment Opportunity Commission’s lawsuit against Signal. The suit contends that the company engaged in human labor trafficking and subjecting the plaintiffs to a hostile work environment because of their nationality.

In one well-known Long Island environmental case brought by the New York State Department of Environmental Conservation (“NYSDEC”) against several potentially responsible parties (“PRPs”) — including one of her clients — the United States District Court decided in favor of the PRPs on a motion for summary judgment. She argued that the statute of limitations had run before the state had offered and entered into tolling agreements with her client and the other PRPs so that the state was barred from bringing the action. The argument was complicated by the fact that the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA” or “Superfund”) provides different statute of limitations for removal and remedial actions.

Ms. Pincus was previously the Associate General Counsel for the Long Island Power Authority (LIPA), one of the largest municipal electric utilities in the nation. While working for LIPA, she provided legal support in areas such as municipal real property issues, zoning and land use, and other utility matters. She also provided oversight on litigation and internal employment matters and addressed issues affecting LIPA's Board of Trustees.

Daniel Braff and Michael Sahn Published In The New York Real Estate Journal.

Partner Daniel Braff and Managing Partner Michael Sahn of Sahn Ward Braff Koblenz Coschignano & Baker, PLLC wrote an opinion piece in the New York Real Estate Journal on how municipalities on Long Island should follow New York City’s lead and adopt initiatives regarding flood and storm resiliency zoning amendments and “green” and on-street parking initiatives.

In their article, Mr. Braff and Mr. Sahn explain how flood and storm resiliency zoning amendments can protect property from future catastrophic natural events such as Hurricane Sandy and help reduce flood insurance rates. Further, they state that Long Island should look into “green” initiatives acted upon by the city, such as energy-efficient housing, solar panels on roofs and streetscapes. This would beautify neighborhoods, reduce reliance on energy and eliminate greenhouse gas emissions.

Mr. Braff and Mr. Sahn also touted off-street parking amendments, which would cut down on vehicle emissions and encourage residents to take public transit, while solving the parking problem on Long Island.

Michael Sahn Attends the Burton Awards for Legal Achievement.

On June 3, Michael Sahn, the managing partner of Sahn Ward Braff Koblenz Coschignano & Baker, PLLC, attended the Burton Awards for Legal Achievement in Washington, D.C. Now in its fourteenth year, The Burton Awards recognizes and rewards legal scholarship, writing and achievements in the law by partners and counsel from the nation's law firms, members of the Judiciary and legal educators. This year's program featured a presentation of the "Contemporary Book of the Year in Law Awards" to U.S. Supreme Court Justice Sonia Sotomayor, followed by an interview with the judge.

Adam H. Koblenz (front row, second from right), an associate with Sahn Ward Braff Koblenz Coschignano & Baker, PLLC, was Tennis Co-Chair for the Children's Medical Fund of New York's 38th Annual Golf and Tennis Charity Classic, which was recently held at the Glen Oaks Club. He currently serves as one of the Vice Presidents of the Men's Division.

Mr. Koblenz has been involved in the CMF for many years, having also chaired the "Cycle for CMF" event in March. Children's Medical Fund of New York is a nonprofit organization dedicated to raising funds for the Steven & Alexandra Cohen Children's Medical Center of New York. Sahn Ward Braff Koblenz Coschignano & Baker, PLLC has announced that the law firm is expanding with the opening of a New York City office inside the Chrysler Building at 405 Lexington Avenue, 26th Floor. The new office will enable the firm to better service those clients in the Metropolitan area, especially as both the firm's New York City land use and zoning, and litigation practices continue to grow.

Partner Dan Braff is leading the development of the firm's New York City land use and zoning practice with an emphasis on matters before the Board of Standards and Appeals, the City Planning Commission, the Department of Buildings and the Landmarks Preservation Commission. Dan Braff Secures 10 Year Extension for Parking Garage from NYC Board of Standards and Appeals.

On Tuesday, June 11, 2013, Dan Braff secured approval from the New York City Board of Standards and Appeals to extend the term of a variance that authorized an attended below-grade transient parking garage on East 29th Street in Manhattan. The garage originally received a variance under the New York State MultipleDwelling Law in 1966, to permit the use of an accessory parking garage for attended transient parking despite being located in a residential zoning district (where transient parking was not permitted). Dan secured the approval in less than 3 months. As part of the application, Mr. Braff also presented the application to Manhattan Community Board 6, which recommended that the Board of Standards and Appeals approve the application.


Law Firm Assists Roslyn Highlands Hook and Ladder, Engine and Hose Company in Obtaining Land Use and Building Approvals and Tax-Exempt Bonds for New Firehouse Substation.

Michael Sahn, Managing Partner, and Daniel Braff, Partner, of Sahn Ward Braff Koblenz Coschignano & Baker, PLLC, announced that the law firm successfully represented Roslyn Highlands Hook and Ladder, Engine and Hose Company, Inc., in obtaining land use and building approvals for a new firehouse substation located at Harbor Hill Road in East Hills (next to the East Hills Park). The construction of the new firehouse substation was financed with tax-exempt bonds. The law firm also represented the fire company in the tax-exempt bond transaction.

The new 7,842-square-foot substation replaces an obsolete firehouse substation at the same property, and provides not only fire protection services for local residents, but also emergency medical services and an ambulance response team. The Village of East Hills provided the necessary land use permits for the new substation.

The Town of North Hempstead authorized the issuance of $3.415 million in tax-exempt bonds to finance the construction of the new firehouse. The tax-exempt bonds allowed the fire company to borrow the funds at a lower interest rate as compared to a conventional loan, thereby saving the local taxpayers significant sums over the course of the loan. The support of the Village of East Hills in the land use approvals, and the support of the Town of North Hempstead in authorizing the issuance of the tax-exempt bonds, made this a successful collaborative and collective effort of government and the volunteers of the fire company.

The firm’s efforts were acknowledged by James A. McCann, President of the Roslyn Highlands Hook and Ladder, Engine and Hose Company. “Without the guidance and exceptional support of Michael Sahn and Daniel Braff of Sahn Ward Braff Koblenz Coschignano & Baker, our ten-year quest to construct a modern fire station would not have become a reality. Their expertise and personal commitment to our project was unparalleled. Their hard work and dedication culminated in a firehouse which is not only appropriate to our current and future needs, it complements the surrounding community,” said Mr. McCann.

“It was a privilege to have been chosen by the fire company and represent them in this project, which will assist in their efforts to serve the public and bring together firefighting, Emergency Medical Services and ambulance services under one roof,” Mr. Sahn said.

Sahn Ward Braff Koblenz Coschignano & Baker, PLLC will be one of the participating sponsors for this year's Marcum Workplace Challenge, which will take place July 30 at 7 p.m. at Jones Beach State Park.

Daniel H. Braff Promoted to Partner

Sahn Ward Braff Koblenz Coschignano & Baker, PLLC, has announced that Daniel H. Braff, counsel with the firm, has been named Partner.

Mr. Braff concentrates his practice in zoning and land use planning, real estate, environmental and telecommunications law, with a particular emphasis on regulations governing the use of development of real property within the City of New York. He provides zoning analyses, counsels clients in connection with air rights transfers, advises on environmental matters and represents clients before various city agencies, including the Board of Standards and Appeals, the City Planning Commission, the Department of Buildings and the Landmarks Preservation Commission.

He has also secured local discretionary approvals for numerous complex public utility projects throughout the tri-state area, including telecommunications towers, telephone switching facilities and electric utility substations. In addition, Mr. Braff has handled several high-profile New York City development projects, including securing approval from the New York City Board of Standards and Appeals for a new chapel in Flushing, Queens, on behalf of The Church of Jesus Christ of Latter-Day Saints.

Mr. Braff is admitted to practice in both the states of New York and New Jersey. He is also a member of the Land Use Planning and Zoning Committee of The Association of the Bar of the City of New York and a member of the New York State Bar Association. He is also an active member of the UJA-Federation of New York’s Real Estate Executives (REX) group, a member of the New Leadership Division at the North Shore-LIJ Health System and a Weinfeld Associate at New York University School of Law.

After receiving his Bachelor of Arts degree in Environmental Sciences from Lehigh University in 2000, he attended the New York University School of Law, where he received his Juris Doctor in 2003.

Managing Partner Michael Sahn and Judge Edward McCabe are featured in the March 8-14, 2013 edition of Long Island Business News in an article entitled: "Bench Players". The article examined the recent trend amongst the top Long Island law firms of hiring former New York State Supreme Court justices following State mandated retirement, and the unique benefits, perspectives and referrals these former judges add to private practice. Judge McCabe stepped down from the bench in 2009 after 23 years of public service. His tenure included six years as chief administrative judge of Nassau County courts. Click here to learn more.


Sahn Ward Braff Koblenz Coschignano Coschignano & Baker, PLLC Wins Decision in International Contract Dispute

The firm successfully opposed a plaintiff’s attempt to amend a complaint in a complex international contract dispute concerning the purchase and shipment of confectionary equipment involving European business entities. Partners, Jon A. Ward, Esq. and Andrew M. Roth, Esq., and associate Joseph R. Bjarnson, Esq., represented the business entity being sued in the United States District Court for the Eastern District of New York by the plaintiff, a purchaser based in Switzerland, for, inter alia, breach of contract and breach of the implied covenant of good faith and fair dealing.

In GFE Global Finance & Engineering Ltd. v. ECI Limited (USA), Inc., et al., No. 12-CV-1801 (E.D.N.Y.), the plaintiff sought to amend its complaint, for the second time, to assert claims of breach of contract and breach of the implied covenant of good faith and fair dealing against ECI Limited (USA), Inc. (“ECI”) based on the allegation that ECI did not assist plaintiff in obtaining a copy of a bill of lading meant for plaintiff that ECI instead delivered to plaintiff’s agents, who were allegedly not acting with plaintiff’s authority or on its behalf. In its previous complaints, plaintiff had asserted causes of action for breach of contract, specific performance and conversion based on similar facts.

The District Court denied plaintiff’s motion pursuant to Federal Rule of Civil Procedure 15(a)(2) for leave to amend its complaint on the grounds that plaintiff’s claims for breach of contract and breach of the implied covenant of good faith and fair dealing were futile. Specifically, the District Court held that after ECI had delivered the bill of lading to plaintiff’s agent, as was contemplated under the contract and in prior dealings between the entities, ECI was not under further duty to supply plaintiff with a duplicate bill of lading after plaintiff’s agents failed to deliver the document to it. The District Court noted that plaintiff could not point to any provision of the contract, or case authority, requiring ECI to take further actions, nor could plaintiff point to any allegation that ECI acted in bad faith by delivering the bill of lading to plaintiff’s agents, especially since plaintiff acknowledged that ECI had rightfully relied upon the agents’ apparent authority to act on plaintiff’s behalf at the time ECI delivered the bill of lading.

Sahn Ward Braff Koblenz Coschignano & Baker, PLLC Wins Dismissal for Employers of Fair Labor Standards Act and New York Labor Law Claims in Employment and Labor Lawsuit

The firm recently won dismissal in a complex employment and labor case for three (3) separate companies operating under a trade name in the commercial kitchen cleaning and repair business. Partner, Jon A. Ward, Esq., and associates Ralph Branciforte, Esq. and Adam H. Koblenz, Esq. represented the businesses being sued in Manhattan Federal Court by former industrial cleaning employees for, inter alia, violations of the Fair Labor Standards Act, New York Labor Law and unjust enrichment for alleged nonpayment of overtime wages.

Partner Miriam Villani and Jason Kaplan recently attended the New York State Bar Association Environmental Law Section’s Annual Meeting in New York City on January 24 and 25, 2013. Miriam, the current editor-in-chief of the Section’s Journal The New York Environmental Lawyer, and Jason, the Co-Chair of the Section’s Membership Committee, engaged in panel discussions on zoning and redevelopment of contaminated properties as well as the complexities of SEQRA. Miriam and Jason also attended the NYSBA Environmental Law Section’s Fall Meeting on Oct. 12-14th in Lake Placid, New York.
